1. INTRODUCTION

These Terms and Conditions govern the sale of vehicles and related services by Bervie Motors. By purchasing a vehicle from us, you agree to these terms.


2. VEHICLE SALES

2.1 Vehicle Description

We strive to ensure that all vehicle descriptions, prices, and specifications are accurate. However, minor discrepancies may occur. Buyers should inspect vehicles and verify details before purchase.


2.2 Used Vehicles

Used vehicles are sold as described and may exhibit wear and tear consistent with age and mileage. Any known faults will be disclosed before sale.


2.3 Pricing

All prices include VAT (where applicable) unless otherwise stated. Prices are subject to change without prior notice.


3. PAYMENT TERMS

3.1 Payment Methods

We accept payment via bank transfer, debit/credit cards, and cash. Full payment must be received before vehicle collection.


4. CONSUMER RIGHTS & RETURNS

4.1 Faulty Vehicles

It is the responsibility of the consumer to satisfy themselves regarding their rights under the Consumer Rights Act 2015. Customers should conduct their own research or seek legal advice if necessary.


4.2 Distance & Online Sales

If the purchase is made online or off-premises, customers have a 14-day cooling-off period under the Consumer Contracts Regulations 2013, during which they can return the vehicle for a full refund. The vehicle must be returned in the same condition, and the buyer is responsible for return costs. If the vehicle is damaged, additional charges will apply for repairs. Any extra mileage covered from the time of sale until the return will be charged at 45 pence per mile plus VAT (20%).


5. WARRANTIES & SERVICING

5.1 Warranty Coverage

All vehicles come with a 3-month dealer warranty covering major mechanical faults.


5.2 Exclusions

Warranties do not cover general wear and tear, accidental damage, misuse, or routine maintenance (e.g., tires, brakes, oil changes).


6. VEHICLE DELIVERY & COLLECTION

6.1 Collection

Customers must collect their vehicle from our dealership unless delivery is arranged. Proof of ID and full payment are required upon collection.


6.2 Delivery

Delivery services may be available at an additional cost. Delivery dates are estimates and may be subject to delays beyond our control.


7. LIABILITY & DISCLAIMERS

  • We are not liable for any losses due to vehicle breakdowns after purchase unless covered under warranty.
  • We are not responsible for any insurance, road tax, or other legal requirements post-purchase.


8. DATA PROTECTION & PRIVACY

We handle customer data per the UK GDPR and Data Protection Act 2018. Personal details will not be shared with third parties except for legal compliance.


9. COMPLAINTS & DISPUTE RESOLUTION

If you have a complaint, please contact us at sales@berviemotors.co.uk. Unresolved disputes may be referred to the Motor Ombudsman or Trading Standards.


10. GENERAL TERMS

  • These terms are governed by UK law.
  • Any disputes shall be handled in UK courts.
  • We reserve the right to amend these terms at any time.
